Article 1: General provisions

The e-commerce website of Don Domino, a limited liability company with its registered office at Waterhoevelaan 1, 2960 Brecht, Belgium, VAT BE0770.394.487 offers its customers the opportunity to purchase the products in its online store.

These General Terms and Conditions (“Conditions”) apply to any order placed by a visitor to this e-commerce website (“Customer”). When placing an order through Don Domino’s online store, the Customer must expressly accept these Terms and Conditions, thereby agreeing to the applicability of these Terms and Conditions to the exclusion of all other terms and conditions. Additional conditions of the Customer are excluded, except when previously, in writing and expressly accepted by Don Domino.

Article 2: Prices

All prices are expressed in EURO, always including VAT and all other compulsory fees or taxes to be borne by the Customer.

If delivery, reservation or administrative costs are charged, this will be indicated separately.

The price stated refers exclusively to the articles as described word for word. The accompanying photos are for decorative purposes only and may contain elements that are not included in the price.

Article 3: Offer

Despite the fact that the online catalog and the e-commerce website are composed with the utmost care, it is still possible that the information is incomplete, contains material errors, or is not up to date. Obvious mistakes or errors in the offer do not bind Don Domino. Don Domino is regarding the accuracy and completeness of the information offered only bound to a means obligation. Don Domino shall under no circumstances be liable for obvious material errors, misprints or printing errors.

If the customer has specific questions about e.g. sizes, color, availability, delivery time or delivery method, we request the customer to contact our customer service department first.

The offer is always valid while stocks last and can be modified or withdrawn by Don Domino at any time. Don Domino cannot be held responsible for the unavailability of a product. If an offer has a limited validity or is made under conditions, this will be explicitly mentioned in the offer.

Article 4: Online purchases

The Customer has the option of adding each item to the shopping cart. Through the shopping cart, the Customer can fill in the necessary contact and shipping information, and then proceed to checkout.

The Customer has the choice between the following payment methods:

Don Domino has the right to refuse an order due to a serious shortcoming of the Customer regarding orders involving the Customer.

Article 5: Delivery and execution of the agreement

Items ordered through this webshop will be delivered in all countries of the European Union, as well as some additional European countries. The full list of countries can be consulted on the page Shipping costs.

Delivery is made by specialized shipping services, such as DPD, PostNL and Bpost. The cost of delivery can be consulted on the page Shipping costs.

Unless otherwise agreed or expressly provided, the goods will be delivered to the Customer’s home within 30 days of receipt of the order.

Any visible damage and / or qualitative deficiency of an article or other shortcoming in the delivery, must be immediately reported by the Customer to Don Domino.

The risk due to loss or damage shall pass to the Customer as soon as he (or a third party designated by him, who is not the carrier) has received physical possession of the goods. However, the risk shall already pass to the Customer upon delivery to the carrier, if the carrier was instructed by the Customer to transport the goods and this choice was not offered by Don Domino.

Article 6: Reservation of title

The delivered goods remain the exclusive property of Don Domino until full payment by the Customer.

The customer undertakes, if necessary, to inform third parties of the retention of title of Don Domino, eg to anyone who may come to seize the items not paid for in full.

Article 7: Right of withdrawal

The provisions of this article apply only to Customers who, in their capacity as consumers, purchase items online from Don Domino.

The Customer has the right to withdraw from the agreement within a period of 30 calendar days without giving any reason.

The revocation period expires 30 calendar days after the day on which the Customer or a third party designated by the Customer, who is not the carrier, takes physical possession of the good.

To exercise the right of withdrawal, the Customer must inform Don Domino, Waterhoevelaan 1, 2960 Brecht, Belgium, info@dondomino.eu via an unequivocal statement (e.g. in writing by post or e-mail) of its decision to withdraw from the contract. The Customer may use the attached model withdrawal form for this purpose, but is not obliged to do so.

To comply with the withdrawal period, the Customer must send his communication regarding his exercise of the right of withdrawal before the withdrawal period has expired.

The Customer must return or hand over the goods to Don Domino, Waterhoevelaan 1, 2960 Brecht, Belgium, without delay, but in any event no later than 30 calendar days from the day on which he communicated his decision to withdraw from the agreement to Don Domino. The Customer is on time if he returns the goods before the 30 calendar day period has expired.

The direct cost of returning the goods shall be borne by the Customer.

If the returned product is in any way impaired in value, Don Domino reserves the right to hold the Customer liable and claim damages for any impairment of the goods resulting from the Customer’s use of the goods beyond what is necessary to establish the nature, characteristics and functioning of the goods.

Only items that are in their original packaging, together with all accessories and invoice or proof of purchase can be returned.

If the Customer revokes the agreement, Don Domino will refund all payments received from the Customer to that date, including standard delivery charges, within a maximum of 14 calendar days of Don Domino being informed of the Customer’s decision to revoke the agreement. In the case of sales contracts, Don Domino may wait to refund until it has received all the goods back, or until the Customer has demonstrated that it has returned the goods, whichever comes first.

Any additional costs resulting from the Customer choosing a method of delivery other than the cheapest standard delivery offered by Don Domino will not be refunded.

Don Domino will refund the Customer using the same means of payment the Customer used to make the original transaction, unless the Customer has expressly agreed otherwise; in any case, the Customer will not be charged for such refund.

Article 8: Guarantee

Under the Act of September 21, 2004 on the protection of consumers in the sale of consumer goods, the consumer has legal rights. This legal warranty applies from the date of delivery to the first owner. Any commercial guarantee does not affect these rights.

To invoke the warranty, the Customer must be able to present proof of purchase. Customers are advised to keep the original packaging of the goods.

For items purchased online and delivered to the Customer’s home, the Customer must contact customer service and return the item to Don Domino at his expense.

If a defect is found, the Customer must inform Don Domino as soon as possible. In any case, any defect must be reported by the Customer within 2 months of its discovery. Afterwards, any right to repair or replacement expires.

The warranty (commercial and/or legal) shall never apply to defects caused by accidents, neglect, falls, use of the article contrary to the purpose for which it was designed, failure to comply with the instructions for use or manual, modifications or alterations to the article, heavy-handed use, poor maintenance, or any other abnormal or incorrect use.

Defects that become apparent after a period of 6 months following the date of purchase, or delivery as the case may be, are not considered to be hidden defects, unless the Customer can prove otherwise.

Article 10: Penalties for non-payment

Without prejudice to the exercise of other rights available to Don Domino, in the event of non-payment or late payment, the Customer shall be liable, ipso jure and without warning, to interest of 10% per year on the unpaid amount from the date of the default. In addition, the Customer shall be liable, ipso jure and without notice, to a fixed compensation of 10% of the amount in question, with a minimum of €25 per invoice.

Without prejudice to the foregoing, Don Domino reserves the right to take back non (fully) paid items.

Article 13: Invalidity – non-waivers

If any provision of these Terms and Conditions is declared invalid, unlawful or void, this shall not in any way affect the validity, legality and applicability of the other provisions.

The failure at any time by Don Domino to enforce any of the rights enumerated in these Terms and Conditions, or to exercise any of them, shall never be considered a waiver of such provision and shall not affect the validity of these rights.

Article 14: Amendment of terms and conditions

These Terms and Conditions are supplemented by other terms and conditions expressly referred to, and the general sales conditions of Don Domino. In case of contradiction, these conditions shall prevail.

Article 15: Proof

The Customer accepts that electronic communications and backups may serve as evidence.

Article 16: Applicable law – Disputes

Belgian law shall apply, with the exception of the provisions of international private law concerning applicable law.

The courts of the Consumer’s place of residence have jurisdiction in the event of legal disputes. The Consumer may also turn to the ODR platform (http://ec.europa.eu/consumers/odr/).

Article 17: Language

This Agreement has been drawn up in the English language. In case of discrepancies between the English text version of this Agreement and any translation, the English version shall prevail.
